Terms of Use

Last updated: 2026-09-08. This English text is a convenience translation. In the event of any discrepancy, the German version of these Terms of Use prevails.

1. Scope and contracting party

(1) These Terms of Use govern the use of the web application Warcodex, available at www.warcodex.app (the „Service“). (2) The provider and your contracting party is: Maximilian Iliew Eislebener Str. 4 10789 Berlin Germany Email: [email protected] Full provider details are set out in the Imprint. (3) These Terms apply to everyone who creates a user account or uses the Service (the „User“). Deviating or supplementary terms of the User do not become part of the contract unless we expressly agree to them in text form. (4) These Terms are linked in the registration form before the user contract is concluded. You can access, save and print them there. By ticking the dedicated checkbox and submitting the registration you declare your agreement that these Terms apply.

2. Nature of the offering

(1) Warcodex is a private, non-commercial fan project made by players for players. The Service is provided free of charge and without any intention to make a profit. No paid content, subscriptions or paywalls are offered. There is no advertising, and no data is sold to third parties. (2) Warcodex is unofficial and not affiliated with Games Workshop. Warhammer 40,000 is a registered trademark of Games Workshop Ltd. All trademarks, product names, unit and faction designations mentioned are the property of their respective owners and are used here purely descriptively in the context of a fan project. (3) Warcodex does not replace official rulebooks, codices or points lists. The respective current official publications of the rights holder always prevail. (4) There is no entitlement to the provision, continued existence or any particular scope of functions of the Service.

3. Registration, account and minimum age

(1) Use of the Service requires a user account. There is no entitlement to registration. (2) The Service is addressed exclusively to persons who have reached the age of 16. By registering you confirm that you are at least 16 years old. If we learn that an account is held by a younger person, we are entitled to suspend and delete that account. (3) The information provided on registration must be truthful and complete. Please keep it up to date in your account, in particular your email address. (4) After registration we send a confirmation email to the address provided. The account can only be used once the link contained in that email has been opened. The confirmation link is valid for 24 hours. Accounts that have not been confirmed are deleted automatically no later than 30 days after registration. (5) One account per person is permitted. Multiple accounts, in particular in order to circumvent suspensions or protective measures, are prohibited. (6) Your credentials must be kept confidential and must not be passed on to third parties. Use a secure password that you do not use elsewhere. If you have any indication of unauthorised access, please notify us immediately at [email protected] and change your password.

4. Your content

(1) You can create and upload your own content in the Service, for example army lists, collection and game data, battle reports, photos, profile details and the names of opponents („User Content“). (2) You are responsible for your User Content. You warrant that you hold the necessary rights and that the content does not infringe applicable law, third-party rights or these Terms. (3) In particular, it is prohibited to upload or post protected artwork, illustrations, logos, icons or third-party product photos, as well as verbatim rules text, codex extracts or points listings of the rights holder. Upload only your own imagery, in particular photos of your own models and games. (4) If you record the name of an opponent or other details about third parties, only record data you are entitled to provide, and limit yourself to what is necessary to document the game. (5) Your content is private by default. Publication, for example via a public profile, share links or the leaderboard, only takes place if you activate it yourself. Details are set out in the Privacy Policy.

5. Rights in User Content

(1) Your User Content remains yours. We do not acquire ownership of it. (2) You grant us a non-exclusive, royalty-free right, revocable at any time, to store, technically reproduce and back up your User Content and to display it to you and, insofar as you have actively enabled this, to the audience you have chosen, in each case solely for the purpose of operating the Service. Technical processing such as scaling, format conversion or removal of metadata is permitted insofar as it is necessary for display and storage. (3) Any use beyond this, in particular commercial exploitation, transfer to third parties or sublicensing, does not take place. (4) The licence ends as soon as you delete the respective content or have your account deleted (see section 10 and the privacy policy). This does not affect technically necessary backup copies until they are overwritten in the regular cycle.

6. Prohibited use

The following is prohibited in particular: a) posting unlawful, insulting, discriminatory, youth-endangering content or content that infringes third-party rights; b) automated reading, copying or re-use of content or data of the Service (scraping, crawling, bulk retrieval) without our prior consent; c) circumventing, disabling or overloading protective mechanisms, in particular bot protection, access restrictions, rate limits and authentication; d) attacks on the availability or integrity of the Service, exploitation of security vulnerabilities and the introduction of malware; e) use of the Service or its data for commercial purposes, for advertising or for resale; f) use of other people's accounts and impersonation of another identity. You may report security vulnerabilities to us at any time at [email protected]. Exploitation going beyond the minimum testing required for proof is not permitted.

7. Reporting unlawful content

If you believe that content available in the Service infringes rights or violates these Terms, please report this to us at [email protected]. It is helpful to include the exact location (URL), a description of the content complained about, the reasons for the alleged infringement and your contact details. We review reports promptly and remove or block unlawful content without undue delay after obtaining knowledge of it. In cases of manifest infringement we reserve the right to make the content in question inaccessible as a precaution until the review is complete. We inform the reporting person and, where possible and permissible, the person whose content is affected about the outcome.

8. Availability and changes to the Service

(1) The Service is provided without any warranty of a particular level of availability. Maintenance, technical faults, capacity limits and changes to third-party data sources may lead to temporary or permanent restrictions. (2) We may change, extend or restrict the scope of functions at any time, or discontinue the Service entirely. We will announce a planned complete discontinuation with reasonable notice in the Service or by email, where this is reasonable, so that you can secure your data. (3) Rules, points and unit data are maintained to the best of our knowledge but may be incomplete, outdated or incorrect. They do not replace official publications. No warranty is given as to accuracy or currency. (4) Securing your own data is your responsibility insofar as export functions are available to you.

9. Liability

(1) We are liable without limitation for damage arising from injury to life, body or health based on a breach of duty by us, our legal representatives or vicarious agents, as well as for damage based on intent or gross negligence, and further under the German Product Liability Act and within the scope of any guarantee given by us. (2) In the case of a slightly negligent breach of a material contractual obligation, that is an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, our liability is limited to the foreseeable damage typical for this type of contract. (3) Otherwise liability is excluded. In particular, in cases of slight negligence we are not liable for loss of data, loss of use or indirect damage. (4) The above limitations of liability also apply for the benefit of our legal representatives and vicarious agents. They do not involve any change in the burden of proof to your detriment. (5) If your User Content culpably infringes third-party rights, you shall indemnify us against justified third-party claims based on this, insofar as you are responsible for the infringement.

10. Term, account deletion, suspension and termination

(1) The user contract is concluded for an indefinite period. (2) You may request the deletion of your account at any time and without giving reasons, informally by email to [email protected]. We will confirm receipt and carry out the deletion within the statutory period; the contract ends upon deletion. We do not currently offer a deletion function directly in the account settings. (3) We may terminate the contract at any time with 14 days' notice in text form, in particular by email. (4) In the event of a serious or repeated breach of these Terms, we may temporarily suspend your account or terminate the contract without notice for good cause. Before taking a permanent measure we will, where possible and reasonable, hear you and give reasons for the measure. (5) Which data is retained for how long after a suspension or deletion is governed by the Privacy Policy.

11. Changes to these Terms of Use

(1) We may amend these Terms where this is necessary to adapt them to a changed legal situation or case law, to changed technical circumstances or to a changed scope of functions, and where this does not unreasonably disadvantage you. (2) We will inform you of intended changes at least 30 days before they take effect, by email to the address you have provided or by a clear notice in the Service. (3) Material changes require your consent. We obtain it the next time you sign in. If you do not consent, you may end the contract at any time by deleting your account; we may in that case end the contract in accordance with clause 10 paragraph 3. Consent is not deemed to be given by mere silence. (4) Purely editorial changes without effect on rights and obligations, such as correcting typographical errors or updating contact details, are made without a separate procedure. (5) The version in force at any given time is available at www.warcodex.app/agb and carries a date of issue.

12. Applicable law and dispute resolution

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If your habitual residence is in another state, the protection afforded by the mandatory consumer protection provisions of that state remains unaffected. (2) The European Commission discontinued its Online Dispute Resolution (ODR) platform on 20 July 2025. There is therefore no longer any obligation to provide information about it or to link to it. (3) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. (4) For complaints or disagreements you can reach us at [email protected]. We endeavour to resolve concerns directly and amicably.

13. Final provisions

(1) Should individual provisions of these Terms be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected. The statutory provisions take the place of the invalid provision. (2) There are no oral side agreements. Amendments and supplements require text form. (3) Rights and obligations under this contract may not be transferred to third parties without our consent. (4) Our Privacy Policy applies in addition. It is not a contractual term but informs you pursuant to Article 13 GDPR about how we process your data.
